    These Terms of Service govern your use of Webistry's website and services. "Webistry," "we," "us," and "our" refer to Webistry. "Client," "you," and "your" refer to the person or business purchasing or using our services.

    1. Services

    Webistry provides done-for-you website design, development, business-system setup, intake, analytics, booking, lead-management, payment, and related digital services for businesses. The exact services, package, price, and deliverables are the ones shown at checkout, in writing, or in your approved project scope.

    2. Business Use

    Our services are intended for business customers. By purchasing, you confirm that you are authorized to act for the business you provide and that the information you submit is accurate.

    3. Payment

    Payment is processed by Stripe. Full payment is required before project work begins unless we agree otherwise in writing. We do not store your full card number. Taxes, third-party fees, domain fees, subscription fees, and provider fees may be separate unless expressly included.

    4. Checkout Acceptance

    By completing checkout, submitting intake information, or using our services, you agree to these Terms, our Privacy Policy, and our Refund Policy.

    5. Project Timeline

    We aim to deliver most website builds within 3-5 business days after payment and after we receive the required intake information, assets, access, and approvals. Timelines may change if information is incomplete, third-party services are delayed, the scope changes, or you do not respond promptly.

    6. Client Responsibilities

    You are responsible for providing accurate business information, photos, logos, testimonials, access credentials, domain preferences, content, approvals, and legal rights to all materials you submit. You must not submit unlawful, infringing, misleading, or confidential third-party material you are not authorized to use.

    7. Revisions

    Webistry includes 30 days of in-scope revisions after initial delivery unless otherwise stated. "Unlimited revisions" means reasonable iterative edits within the original scope. It does not include a full rebuild, new package, new brand direction, new pages, advanced custom features, third-party fees, or work caused by inaccurate information you provided.

    8. AI-Assisted Services

    We may use AI-assisted tools to draft copy, layouts, code, research, summaries, outreach, and strategy. AI output is reviewed and adapted by Webistry, but you are responsible for reviewing final content for accuracy, legal claims, licensing, testimonials, pricing, credentials, and industry-specific compliance before publication.

    9. Third-Party Services

    Our services may use third-party platforms such as Stripe, Supabase, Cloudflare, Brevo, Quo/OpenPhone, Calendly, Meta, Anthropic or other AI providers, Cloudinary, and search/enrichment providers. We are not responsible for outages, policy changes, pricing changes, account suspensions, deliverability decisions, payment holds, or other third-party actions.

    10. No Guaranteed Results

    We do not guarantee revenue, leads, bookings, search rankings, ad performance, message deliverability, conversion rates, or business outcomes. We build and support the agreed digital assets and systems, but results depend on market, offer, traffic, competition, reputation, client follow-through, and third-party platforms.

    11. Ownership

    After full payment, you own the final custom website content and assets created specifically for your business, excluding Webistry's pre-existing templates, systems, tools, frameworks, workflows, reusable code, internal processes, and know-how. Webistry retains ownership of its reusable materials and may reuse general ideas, layouts, components, and methods.

    12. Submitted Materials

    You grant Webistry permission to use, edit, host, process, display, and transmit materials you submit for the purpose of providing services. You confirm that you have the rights needed for us to use those materials.

    13. Portfolio Use

    Unless you ask us in writing not to, you allow Webistry to show your finished project, business name, screenshots, and general results in our portfolio, marketing, proposals, and case studies.

    14. Domains, Hosting, and Accounts

    Domain availability is not guaranteed until registered. You are responsible for maintaining third-party accounts, billing, logins, DNS, domain renewals, hosting, payment processor accounts, and platform terms unless we expressly agree to manage them.

    15. Communications

    We may contact you by email, phone, SMS, or other channels about your purchase, project, support, billing, and related services. Marketing messages may include opt-out instructions where required.

    16. Accessibility

    We aim to build practical, accessible websites and to improve accessibility issues reported to us. Accessibility requirements can vary by business and jurisdiction; unless a specific accessibility audit or compliance scope is purchased, we do not guarantee full legal compliance.

    17. Abandoned Projects

    If we request information, approval, or access and you do not respond for 14 days, we may pause the project. If you do not respond for 30 days or more, the project may be treated as inactive or abandoned, and amounts paid may be non-refundable because time and capacity were reserved.

    18. Prohibited Use

    You may not use our services for unlawful activity, deceptive advertising, spam, harassment, infringement, malware, regulated claims you cannot support, or content that violates third-party platform rules.

    19. Limitation of Liability

    To the maximum extent permitted by law, Webistry is not liable for indirect, incidental, consequential, special, punitive, lost-profit, lost-revenue, lost-data, lost-goodwill, or business-interruption damages. Our total liability for any claim is limited to the amount you paid Webistry for the specific service giving rise to the claim.

    20. Indemnification

    You agree to defend and hold Webistry harmless from claims arising from materials you provide, your business claims, your misuse of the services, your violation of these Terms, or your violation of another party's rights.

    21. Refunds and Chargebacks

    Refunds are governed by our Refund Policy. If you believe there is a billing issue, contact [email protected] before filing a chargeback so we can investigate and resolve it. We may dispute chargebacks with proof of checkout acceptance, service work, communications, and delivery.

    22. Changes

    We may update these Terms from time to time. The version posted on our website applies going forward. Material changes will not reduce rights for a completed purchase unless required by law or agreed in writing.

    23. Governing Law

    These Terms are governed by the laws of Texas, USA, unless applicable law requires otherwise.
